Abstract
Landschapswaarden worden juridisch niet goed beschermd. Kistenkas bestudeerde twee jaar jurisprudentie over bescherming van het landschap. De landschappen ontberen rechtsbescherming, concludeert de jurist daaruit. ‘Nationale Landschappen en hun kernkwaliteiten zijn benoemd in de Nota Ruimte. Dat is geen wet. Ook de nieuwe Structuurvisie Infrastructuur en Ruimte niet. Bij de beoordeling van plannen kijkt de wetgever naar wetgeving en verdragen. Er was geen EHS-wet of Wet nationaal landschap, dus bescherming was niet afdwingbaar'
