Description
This study examines the conceptual and legal framing of Indigenous rights within climate litigation across selected African jurisdictions. It analyses how Indigenous peoples are positioned within these cases and identifies key doctrinal patterns, relevant to the protection of their rights. This thesis systematises the jurisprudence and formulates context specific analytical categories.
